Terms of Service

Please read these terms carefully before using HisabAI.

1. Acceptance of Terms

Welcome to HisabAI (“we”, “our”, “us”). These Terms of Service (“Terms”) govern your access to and use of the HisabAI mobile application, website, and all related products and services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

2. Eligibility

To use HisabAI, you represent and warrant that:

  • You are at least 18 years of age; and
  • You have the legal capacity and authority to enter into a binding agreement under applicable laws.

3. Description of the Service

HisabAI is a digital platform designed to help users:

  • Track and manage personal expenses;
  • Create and manage groups for shared expenses;
  • Split bills and calculate who owes whom;
  • Track settlements between group members;
  • Receive AI-powered spending insights and summaries; and
  • Connect to UPI or other payment apps to complete settlements.

HisabAI is not a bank, Non-Banking Financial Company (NBFC), or financial institution. We:

  • Do not hold user funds;
  • Do not provide loans or credit facilities; and
  • Do not operate as a wallet or payment processor.

4. Account Registration

To access certain features, you may be required to create an account. During registration, you may be asked to provide information such as:

  • Your name;
  • Your mobile number;
  • Your email address (optional); and
  • Other information as reasonably required.

By creating an account, you agree to:

  • Provide accurate, current, and complete information;
  • Maintain and promptly update your information as needed so it remains accurate and complete;
  • Maintain the confidentiality of your login credentials; and
  • Accept full responsibility for all activities that occur under your account.

If you believe your account has been compromised, you must notify us immediately.

5. User Responsibilities

When using HisabAI, you agree that you will not:

  • Provide false, misleading, or inaccurate financial data;
  • Use the Service to conduct or support any illegal or fraudulent activities;
  • Harass, abuse, or harm other users or third parties;
  • Attempt to interfere with or disrupt the integrity, security, or performance of the Service;
  • Attempt to gain unauthorized access to any accounts, systems, or networks related to the Service;
  • Reverse engineer, decompile, or otherwise attempt to discover the source code or underlying components of the Service; or
  • Use AI-generated outputs as a substitute for professional financial, legal, tax, or investment advice.

6. Expense Records & Data Accuracy

HisabAI uses the data you and other users provide to calculate expense splits and settlements. You acknowledge and agree that:

  • All calculations and summaries depend on the accuracy and completeness of the data entered by users;
  • HisabAI is not responsible for any incorrect, incomplete, or outdated expense entries;
  • HisabAI is not a party to any financial arrangement between users and does not mediate disputes; and
  • Any disagreements between group members regarding expenses, contributions, or settlements must be resolved directly between the users involved.

7. AI-Powered Insights

HisabAI may use Artificial Intelligence (AI) or machine-learning models to:

  • Categorize expenses and transactions;
  • Provide summaries of your spending behavior;
  • Offer budget suggestions or alerts; and
  • Generate general financial insights and recommendations based on your data.

You acknowledge and agree that:

  • AI-generated outputs may sometimes be inaccurate, incomplete, or not tailored to your specific situation;
  • Such outputs are intended for informational and assistive purposes only; and
  • They do not constitute professional advice, and you should consult a qualified advisor before making financial decisions.

8. Payments, UPI & Third-Party Apps

HisabAI may allow you to initiate payments or settlements using third-party payment platforms, including but not limited to UPI apps (such as PhonePe, Google Pay, Paytm, etc.).

You understand and agree that:

  • HisabAI does not process or hold payments itself;
  • Payment transactions are executed directly by third-party payment providers;
  • HisabAI does not store sensitive payment information such as UPI PIN, CVV, or full card numbers;
  • HisabAI is not responsible for failed transactions, payment delays, or incorrect recipient details; and
  • Any payment-related issues, chargebacks, or disputes must be raised with the relevant bank or payment service provider.

9. Subscriptions & Premium Features

HisabAI may offer both free and paid subscription plans with different feature sets.

If you purchase a paid subscription, you agree that:

  • Subscription fees and billing cycles will be clearly communicated at the time of purchase;
  • Payments may be processed through third-party platforms (such as Google Play Store or Apple App Store);
  • Subscriptions may auto-renew unless you cancel them within the billing platform;
  • Applicable taxes may be added as required by law; and
  • Refunds, if any, will be handled according to the policies of the respective app marketplace or payment provider.

10. Privacy & Data Protection

Your use of HisabAI is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal data.

In summary, we aim to:

  • Collect only the data necessary to provide and improve the Service;
  • Use industry-standard security measures to protect your data;
  • Never sell your personal data to third parties; and
  • Provide you with options to access, modify, and delete your data, subject to legal obligations.

11. Suspension & Termination

We may suspend or terminate your access to the Service if:

  • You violate these Terms or any applicable law;
  • We suspect fraudulent, abusive, or harmful activity; or
  • We are required to do so by law or regulatory authority.

You may stop using the Service or request account deletion at any time.

Upon termination, your right to use the Service will cease immediately. We may retain certain information as required for legal, regulatory, or legitimate business purposes, in accordance with our Privacy Policy.

12. Intellectual Property

All rights, title, and interest in and to the Service, including but not limited to software, design, text, graphics, logos, trademarks, and other content, are and will remain the exclusive property of HisabAI and its licensors.

You agree not to:

  • Copy, modify, or create derivative works of the Service;
  • Distribute, sell, resell, or lease any part of the Service; or
  • Use any trademarks, logos, or branding from HisabAI without our prior written permission.

13. Third-Party Services & Links

The Service may include links to or integrations with third-party services, websites, or applications. These are provided for your convenience only.

We do not:

  • Control or endorse third-party services;
  • Guarantee their availability, security, or performance; or
  • Assume responsibility for any loss or damage arising from your use of such third-party services.

Your use of third-party services is subject to their own terms and privacy policies.

14. Disclaimer & Limitation of Liability

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

To the maximum extent permitted by law, HisabAI and its affiliates will not be liable for any:

  • Loss of data, income, or profits;
  • Financial losses or disputes between users;
  • Errors or inaccuracies in expense calculations or AI-generated insights;
  • Issues arising from third-party services, including payment providers; or
  • Indirect, incidental, special, consequential, or punitive damages, even if we have been advised of their possibility.

15. Indemnification

You agree to indemnify, defend, and hold harmless HisabAI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Service;
  • Your violation of these Terms; or
  • Your violation of any rights of another person or entity.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page and may provide additional notice as required by law.

Your continued use of the Service after any changes are made constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using the Service.

17. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

You agree that any disputes arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts located in Uttar Pradesh, India.
